5. Landlord Obligations
Landlords engaging our services agree to:
- Provide accurate property and ownership information
- Ensure the property meets all legal requirements for letting
- Maintain appropriate landlord insurance
- Provide necessary access for inspections and maintenance
- Pay agreed management fees in accordance with our agreement
- Inform us of any changes affecting the property or tenancy
- Comply with all applicable landlord legislation and regulations
6. Tenant Obligations
Tenants of properties we manage agree to:
- Pay rent on time as specified in the tenancy agreement
- Treat the property with reasonable care
- Report maintenance issues promptly
- Allow access for inspections with appropriate notice
- Comply with all terms of the tenancy agreement
- Not sublet without written permission
- Provide accurate information during the referencing process
7. Fees and Payments
7.1 Management Fees
Our management fees are clearly stated in individual landlord agreements. We operate on a transparent fee structure with no hidden charges. All fees are detailed before you commit to our services.
7.2 Tenant Fees
In compliance with the Tenant Fees Act 2019, we do not charge tenants any fees for lettings services except those permitted by law (holding deposits, security deposits, default fees for late rent or lost keys, and payments for changes to tenancy agreements requested by the tenant).
7.3 Client Money Protection
All client funds (rent, deposits, and other monies) are held in designated client accounts and protected by our Client Money Protection insurance. We are members of Client Money Protect scheme.
8. Limitation of Liability
8.1 Website Liability
To the extent permitted by law, we exclude all liability for any loss or damage arising from your use of our website, including but not limited to indirect, consequential, or incidental damages. We do not guarantee uninterrupted access to the website.
8.2 Service Liability
We maintain professional indemnity insurance and will perform our services with reasonable skill and care. However, we shall not be liable for:
- Tenant defaults or non-payment of rent (unless we have been negligent)
- Property damage caused by tenants or third parties
- Market fluctuations affecting rental values
- Delays caused by third parties (contractors, councils, utility companies)
- Loss of rental income due to void periods
8.3 Maximum Liability
Our total liability in any matter arising from our services shall not exceed the total fees paid to us in the 12 months preceding the claim, or the limit of our professional indemnity insurance, whichever is greater.
9. Intellectual Property
All content on this website, including text, graphics, logos, images, and software, is the property of Forte Property Group Ltd or our content suppliers and is protected by UK and international copyright laws. You may not reproduce, distribute, or create derivative works without our written permission.
10. Termination
Termination of property management services is governed by individual management agreements. Generally, either party may terminate with written notice as specified in the agreement. We reserve the right to terminate services immediately if you breach these Terms or your management agreement.
11. Complaints Procedure
We are committed to providing excellent service. If you have a complaint:
- Step 1: Contact your account manager directly to discuss the issue
- Step 2: If unresolved, submit a formal complaint in writing to our office
- Step 3: We will acknowledge within 3 working days and respond within 15 working days
- Step 4: If still unresolved, you may escalate to the Property Redress Scheme
As members of the Property Redress Scheme, we provide independent dispute resolution at no cost to you.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of our website or services shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to Terms
We may revise these Terms at any time by updating this page. Changes take effect immediately upon posting. Your continued use of our website following any changes constitutes acceptance of the revised Terms. We recommend reviewing this page periodically.
